All recipients of mental health services are entitled to the following rights: - To be notified of the rights protected by the MMHC.
- To receive mental health services suited to his/her condition; to have services provided in a safe, sanitary, and humane treatment environment; to have the least restrictive services appropriate and available; and to be treated with dignity and respect.
- To have family members treated with dignity and respect.
- To have a person-centered plan of services.
- To have his/her choice of mental health professionals.
- To be informed of his/her clinical status and progress at reasonable intervals.
- To see his/her mental health professional at reasonable times.
- To not have surgery unless consent in obtained from the recipient or his/her guardian.
- To have the side effects of psychotropic medication explained in writing before starting the medication.
- To be protected from abuse and neglect.
- To not be photographed, fingerprinted, audiotaped, or viewed behind one-way glass without prior written consent.
- To unimpeded, private, and uncensored communication by mail and telephone, as well as in-person visits.
- To receive, possess, and use all personal property, unless limitations are in place.
- To have easy access to his/her money in an account in a facility.
- To have labor compensated, other than necessary personal housekeeping in a small group arrangement.
- To not be restrained, except under certain conditions.
- To not be secluded, except under certain conditions.
- To not have his/her freedom of movement restricted more than is necessary to prevent harm to self or others.
- To have all information in his/her record kept confidential, with some exceptions.
- To insert a statement into his/her record correcting or amending the information in the record.
